TWLP Terms of Use is a global community platform for animal rights activists ("TWLP Platform"). The TWLP Platform is operated by TWLP AG ("TWLP"; "we"). Our mission is to provide activists with information, tools and services (collectively "Services") that empower them to promote and pursue common goals with other members of the TWLP community.

These Terms of Use govern your access to the TWLP Platform and the use of Services available on the TWLP Platform. By accessing the TWLP Platform or using the Services, you confirm that you have read our Terms of Use and that you agree to them. We may ask you to give your consent to the Terms of Use by activating a check box, for example if you sign up to join the TWLP Platform or register for specific Services.

TWLP Platform and Services

  • On the TWLP Platform, we provide Services to help you organise and manage events or team activities, educate yourself and others, and communicate with other team members or the TWLP community at large.
  • You may visit the TWLP Platform as a guest ("Guest") and obtain general information about the TWLP Platform and our Services. A restricted number of features of the TWLP Platform are also available to Guests. However, we ask you to sign up and become a registered user of the TWLP Platform ("Member") if you wish to use the full range of Services on the TWLP Platform.

SECTION 1: Your Commitments to us and the TWLP community

  1. We make available the TWLP Platform and grant you access to the TWLP Platform and Services in order to empower you to promote and pursue common goals with the TWLP community. In return, you agree to abide by these Terms of Use.

SECTION 2: Account information and security

  1. You will not use the TWLP Platform unless you are sixteen years (16) of age or older.
  2. You will provide accurate, current and complete information as requested on our registration forms when signing up for the TWLP Platform.
  3. You will keep your password secure and will not give anyone access to your Member account or transfer your Member account to anyone else without our permission.

SECTION 3: Community standards and Member Content

  1. You acknowledge that the TWLP Platform and Services are available for your personal, non-commercial use only.
  2. You are solely responsible for your interactions with other Members.
  3. You are solely responsible for posting, transmitting and/or sharing photos, your profile (including your name, image and likeness), messages, notes, text, information and other content (hereinafter collectively "Member Content") on the TWLP Platform.
  4. You will not post, transmit or share any Member Content that violates or infringes the rights of other Members of the TWLP Platform, or the rights of any third party (e.g. third-party intellectual property or rights), or where applicable laws prohibit the posting, sharing or other use of such Member Content on the TWLP Platform.
  5. You are solely responsible, at your own cost and expense, for creating backup copies of any Member Content you post or store on the TWLP Platform or any other data that you submit to TWLP in any other form.

SECTION 4: Permission to use Member Content

  1. To provide you with Services on the TWLP Platform that allow you to post, transfer or share Member Content, we need you to give us your permission to use your Member Content. By uploading, posting or sharing Member Content on the TWLP Platform, you allow us to use such Member Content.
  2. Specifically, you grant TWLP a non-exclusive, perpetual (unless terminated pursuant to Section 3.4), transferable, sub-licensable, royalty-free and worldwide license to copy, publicly perform or display, reformat, translate, excerpt (in whole or in part) and distribute such Member Content (consistent with our Data Protection Statement and these Terms of Use) on or in connection with the TWLP Platform or the promotion thereof.
  3. You represent and warrant that you have the right to grant this license and you agree to indemnify and hold TWLP harmless from any claims in accordance with Section 8.
  4. You may terminate this license at any time by deleting your Member Content or Member account. You acknowledge, however, that (for technical reasons) Member Content you delete may persist in back-up copies for a limited period, and that Member Content you delete may continue to be stored, posted, shared or otherwise displayed on the TWLP Platform if you have previously shared it with other Members on the TWLP Platform and they have not deleted it.

SECTION 5: Removal of Member Content by TWLP

  1. TWLP reserves the right to remove (without having an obligation to actively monitor) Member Content posted, transmitted or shared in violation of these Terms of Use, including in particular the community standards and requirements for Member Content set forth above in Section 2.3.
  2. Where appropriate, TWLP will notify you when TWLP removes your Member Content for violating the community standards and requirements for Member Content set forth in Section 2.3 of these Terms of Use. However, applicable laws, a court order, or the necessity to protect the rights of others or TWLP's own legitimate interests may prevent TWLP from notifying you.

SECTION 6: Limitations on the use of TWLP Content

  1. The TWLP Platform contains content and technology of TWLP ("TWLP Content"). Copyright, trademark, patent, and/or other intellectual property rights may protect TWLP Content. You acknowledge and accept that except for the limited license granted hereunder, all right, title and interest to the TWLP Platform and the TWLP Content contained therein remains with TWLP or third parties.

SECTION 7: Disclaimer of Warranties

  1. We strive to improve the TWLP Platform continuously and adapt it to the recognisable needs of our users. Yet we provide the TWLP Platform and all Services as is, and we may reserve the right to modify the TWLP Platform or discontinue any Services at any time without prior notification. Therefore:
  2. TWLP disclaims any and all representations and warranties (express or implied) including warranties of title, fitness for a particular purpose, or merchantability;
  3. TLWP cannot and does not guarantee or promise any specific results from the use of the TWLP Platform; and
  4. TWLP neither represents nor warrants that the information and content made available on or through the TWLP Platform (whether TWLP Content or Member Content) is complete, accurate, reliable, current or error-free.
  5. We provide the TWLP Platform and Services over the internet. Thus,
  6. the TWLP Platform or parts of our Services may be temporarily unavailable from time to time for various reasons such as, but not limited to, server maintenance; and
  7. TWLP does not assume any responsibility or liability for any error, omission, interruption, deletion, defect, delay in operation or transmission, unauthorized access to, or alteration of the TWLP Platform or any parts of the Services.

SECTION 8: Limitation of Liability

  1. The liability of TWLP for damages, whether derived from torts or breaches of contract, under these Terms of Use, shall be limited to CHF 1,000.00 (or equivalent) per calendar year. The foregoing limitation of liability shall not apply to damages or losses caused by TWLP's own wilful misconduct or gross negligence, nor shall it exclude TWLP's liability for death or personal injury.
  2. To the maximum extent permitted by law, TWLP shall not be liable, in any event, for any consequential or indirect damages, including without limitation lost profits, the costs of recovery of lost data, the costs of the procurement of substitute tools or services or for any punitive or other non-compensatory damages.

SECTION 9: Indemnification of TWLP

  1. You agree to indemnify and hold TWLP and its affiliates as well as each of their directors, officers, agents, contractors, partners and employees, harmless from and against any loss, liability, claim, demand, damages, costs and expenses, including reasonable attorneys’ fees, arising out of or in connection with any of the following:
  2. Any Member Content you post, transmit or share on or through the TWLP Platform;
  3. Your conduct in connection with your use of the TWLP Platform or in connection with your interaction with other Members;
  4. Any violation of these Terms of Use, of any applicable law or of the rights of any third parties.

SECTION 10: Termination or suspension of Account

  1. These Terms of Use apply if and as long as you use the TWLP Platform or any Services as a Guest or Member. You may terminate your membership at any time by deleting your Member account when able to do so, or by submitting your request for account and personal data deletion in writing to – please send your request from the email address you used to register your account, and confirm your account username. Please allow 2-3 working days for our technical support team to confirm deletion of your account and personal data.
  2. TWLP may permanently disable your Member account if you have clearly and seriously violated these Terms of Use, including in particular the standards set forth in Section 2.2 (Account information and security) or 2.3 (Community standards and Member Content). You may not sign up for a new membership after we have disabled your Member account. However, you may contact us at any time if you think we have disabled your Member account by mistake by writing to from the email address you used to register your user account, and please also state your registered username if known.
  3. Following termination by TWLP or you, the following continues to apply: other Members or Guests retain the right to continue to post, transmit or share Member Content which you had previously shared; and Sections 7, 8 and 10.

SECTION 11: Governing Law and Venue

  1. These Terms of Use shall be exclusively governed by and construed in accordance with the laws of Switzerland. Its conflicts of laws rules shall not apply.
  2. All disputes arising out of your use of the TWLP Platform or Services or otherwise in connection with these Terms of Use shall be resolved exclusively by the ordinary courts in Zurich, Switzerland. TWLP reserves the right to bring any such dispute before a court, which would not have jurisdiction absent this provision.

SECTION 12: Miscellaneous Terms

  1. TWLP may modify these Terms of Use from time to time at its own discretion. You agree that such modification shall be effective upon posting on the TWLP Platform and that you will be bound to any changes when you use the TWLP Platform after such modification is posted.
  2. If any provision of these Terms of Use shall for any reason be held invalid, illegal or unenforceable in any respect, the remaining provisions shall remain in full force and effect. Any provision held invalid, illegal or unenforceable shall be replaced by a provision that closest reflects the intentions contained in the original provision.
  3. The failure to exercise or enforce any right or provision of these Terms of Use shall not constitute a waiver of any prior, concurrent or subsequent breach of the same or any other provisions hereof, and no waiver shall be effective unless made in writing.

SECTION 13: Email Verification and Privacy

  1. After accepting these Terms of Use and submitting your personal data during the user sign-up process, TWLP will send a verification email with a link to confirm that your email account is valid and belongs to you. You will be required to click on the verification link in your email inbox to finish creating your user account.
  2. Section 6 of our Privacy Policy states as follows:

    We share personal data with third-party providers in order to allow the use of maps, file storage, social sharing, activity or notification feeds and further features of the TWLP Platform. In addition, we share personal data with providers that allow us to communicate with you or to optimize the performance of the TWLP Platform. Examples of third party providers include but are not limited to: MailChimp, Rocketchat, Pubnub, Google Analytics, Firebase.

    TWLP guarantees that no data will be forwarded to third parties for marketing purposes. A transmission occurs only on behalf of the data processors for example in case of data backup and data processing.
